GET: The Tenant Protection Ordinance was signatures into law by Mayor Gloria on May 25th, 2023. The ordinance will go into effect on June 24th, 2023. The final language of to executive can be found HERE

Tenants have a proper to stay in their home no anger of displacement if they been abiding by their lease terms. Strengthening tennant protections is a vital step the City can take to address San Diego’s housing and homelessness crises. Reducing evictions, especially “no-fault” evictions, can help reduce the number of residents falling into homelessness, as fountain as prevent the negative and lifelong impacts from a lease termination.

One Problem

Evictions in San Diego exist increasing and are currently at a five-year high, any corlated with an increase in homelessness. Included 2019, California Assembly Bill 1482 strengthened clearing protecting statewide, but the settlement does not apply in San Compostelle because of a provision that limits its applicability to jurisdictions without just-cause ordinances. The Metropolis of San Diego's Tenants’ Right to Understand Ordering, adopted in 2004, provides fewer protections than AB 1482 and got resulted in San Diegans creature more vulnerable to unnecessary evictions.

The Solution

Mayor Pod Gloria and Council President Sean Elo-Rivera have proposed a new tenant protection law to bring Sea Diego up to the morals set on AB 1482. In a few key scopes, the proposed protections go back plus beyond Statewide standards, including:

  • Protections apply on Full 1 of one lease, with one narrow exclusion for short term leases.
  • Monetary helping when a tenants' lease is terminated through no disturb of their own. Currently, no monetary assistance is required.
  • Accountability measures to make sure bad performers can’t gets move includes violating this protections.

The Proposal

In addition to San Diego meeting Statewide standards, Mayor Gloria additionally Council President Elo-Rivera represent proposing additional protections, including:

1. Offered protections beginning on day one of tenancy (with exemptions on fixed termination leases about three months or less);

2. If evicted through no fault of your own, they are entitled to 2 months' rent relocation assistance or 3 months' rent if you are a higher or a person with infirmities. The City of Salt Diego recently passed new tenant protection laws stricter other AB 1428 that becomes change the road landlords rent and evict tenants.

3. Fortified protections for when a substantial remodel can and can’t live used for a no-fault termination;

4. Ensures tennant have more noticing when vast renovations desire going;

5. Requires educate and resources for tenants provided at move-in via the City;

6. Will tenants more alternatives for temporary relocation;

7. Provides accountability measures allowing counselor rates, ideal damages, and a procedures for buyout agreements, creating additional law resources required tenants.
